Terms of Sales

1. IDENTIFICATION OF THE SELLER
These general terms and conditions of sale apply to the sales defined below and carried out by the company LÉTRANGE PARIS (1838 SAS), a simplified joint stock company, with a share capital of 986,511.70 EUROS, whose registered office is located at 91 rue Saint Honoré – 75008 Paris – France, registered in the Paris trade and companies register under number 819 260 993. Its Siret number is 819 260 993 00012 and its intra-community VAT number is FR 95 819 260 993. Its telephone number is as follows: +33 (0)6 62 99 22 95.

 

2. SCOPE AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The purchase of products offered on the website letrange.paris (hereinafter the “ Site ”) and/or by telephone is subject to these general conditions of sale (“ General Conditions of Sale ”).

The Site allows you to order, online via the internet, from the company 1838 SAS (hereinafter “LETRANGE PARIS”) a selection of products from the brand LETRANGE (hereinafter the “ Product(s) ”).

LETRANGE Products are exclusively intended to be sold to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the customer declares that he is acting as an end consumer and that he does not intend to resell, directly or indirectly, the LETRANGE Products for commercial purposes, this commitment constitutes an essential condition for Maison LETRANGE.

The customer certifies that he has the legal capacity to enter into the commitments provided for herein.

LETRANGE PARIS may update these General Terms and Conditions of Sale at any time. You can review the version of the General Terms and Conditions of Sale in force at any time by visiting the “General Terms and Conditions of Sale” section of the Site. The sales contract between you and LETRANGE PARIS will include the terms of your order and the general terms and conditions of sale applicable at the time of your purchase, which apply to the exclusion of all other general terms and conditions or any implied terms of trade, customer or business practice.

 

3. ORDER TERMS

For any questions relating to the Products and your orders, you can contact our customer service (hereinafter the " Customer Service ") by clicking on the "Contact us" link or by telephone on +33 (0)6 62 99 22 95, from Monday to Friday (excluding public holidays), from 10 a.m. to 6 p.m.

The Site allows you to order, online via the internet, from the company LÉTRANGE PARIS, a selection of Products for collection or delivery under the conditions specified in “Shipping Policy”.

You can also order by phone by contacting our Customer Service.

The Site does not allow you to place special orders that consist in particular in the creation of a Product that does not exist or no longer exists in the LETRANGE collection, or in the adaptation/modification of a Product from the LETRANGE collections by LETRANGE PARIS. These General Terms and Conditions of Sale therefore do not apply to special orders. For any special order, please contact our Customer Service by clicking on the "Make an Appointment" link or by telephone on +33 (0)6 62 99 22 95, Monday to Friday (excluding public holidays), from 10 a.m. to 6 p.m.

However, these General Conditions of Sale will apply to any purchase of products personalized at your request (see article 4.2 below).

4. AVAILABILITY OF PRODUCTS

4.1 Provisions specific to the Pre-order

Pre-order means the possibility for the customer to reserve certain Products indicated on the Site before their release date (hereinafter the “ Pre-order ” or the “ Pre-ordered Product ”).

4.2 Provisions specific to Personalization

Personalization means the possibility for the customer to adapt or personalize certain Products from the LETRANGE collections (hereinafter “ Personalization ” or “ Personalized Product ”).

4.3 Availability of Products

Product offers are valid within the limit of available stocks. Indeed, at the time of validation of the order, there may be a difference between the stock available electronically and the existing physical stock (for example in the case of simultaneous orders of the same product by several customers). The sale is therefore conditional on the availability of the Products in stock. Furthermore, LETRANGE reserves ownership of the Products until payment for the Products.

The availability date of a pre-ordered Product will be expressly indicated on the product sheet. In the event of a change in the availability date, you will be immediately informed by email.

In the event that a Product is unavailable after you have placed your order, we will inform you by email or telephone as soon as possible, offering you the option of either ordering another Product presented on the Site as a replacement, or cancelling your order.

LETRANGE PARIS shall not be liable in the event of stock shortages or unavailability of Products.

LETRANGE PARIS reserves the right to change at any time and without notice the Products offered on the Site and/or by telephone.

In order to ensure better quality of service and availability of our Products to all of its customers, LETRANGE PARIS reserves the right to limit the quantity of Products that can be purchased by a customer, in accordance with the applicable provisions in this area and in particular those of Article L. 121-11 of the Consumer Code.

5. ORDER PROCEDURE

5.1. Ordering procedure on the Site

Product Selection

At any time, you can add Products to your selection by clicking on “Add to cart”.

You can view your selection by clicking on “Basket” in the menu at the top right where the following will appear: the photo(s) of the Product(s), its color and reference(s), the quantity(ies) chosen, its (their) unit price(s) and the subtotal of the selection.

5.2. Validation of orders placed on the Site

5.2.a) Validation of the delivery method

You will need to validate your delivery method and complete the delivery information required for the successful dispatch of your order: country of dispatch, title, first name, last name, telephone number, delivery address and any other information required to process your order.
Once this step is completed, click on “Continue”.

5.2.b) Validation of payment of the order

You can use your delivery address as your billing address or enter another one. You will then be prompted to select a payment method (see Article “6. Prices – Accepted Payment Methods”) and enter the relevant information.
At the end of the ordering process described above and after having accepted all of these General Conditions of Sale and Use and the Site's Privacy Policy, click on the "Pay" button.
To confirm a pre-ordered Product, a personalized Product or any other Product requiring an extended shipping time, you must also authorize LETRANGE PARIS to record your bank details, until the shipment of said product and for a maximum period of 12 months, for the purpose of debiting your account when your order is shipped.
You must carefully check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, in particular due to technical limitations of color rendering on your computer equipment, LETRANGE PARIS cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site. If you have any questions about the Products, you can contact our Customer Service.
For more information regarding payment terms (currencies, accepted payment methods, etc.), please refer to the article below “6. Prices – Accepted Payment Methods”.
Once completed, your order is transmitted to LÉTRANGE PARIS for processing. The sales contract will be formed once we have received your order. We will proceed to ship your Product subject to the availability of the purchased Product (as provided above) and the actual payment of the Product.

LETRANGE PARIS reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if LETRANGE PARIS reasonably believes that this customer has breached these General Conditions or has engaged in fraudulent activity, or for any other legitimate reason.

5.2.c) Order summary

A summary of your order will then be sent to you by email (“Your LETRANGE order”). This summary will include the total amount of the order, information relating to the cost and delivery time, the essential characteristics, quantity and price of the Products purchased.
We advise you to keep this summary on an electronic medium.
You will then receive an email confirming the shipment of your order with your electronic invoice attached.

We do everything we can to ensure that our communications are sent to you as quickly as possible.
We advise you to check your "Spam" folder if you have not received the shipping confirmation email.

In application of article L213-1 of the Consumer Code, when an order concerns an amount equal to or greater than 120 Euros, LETRANGE PARIS keeps the written record of the contract concluded between LETRANGE PARIS and a customer electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with decree 2005-137 of February 16, 2005). You then have access to this document at any time, upon request made to Customer Service after proof of your identity.

5.3. Telephone order procedure

You may order a Product by calling our Customer Service (see section "3. Ordering Procedures"). To place an order, you will need to provide the following information (" Order Details "):
- Product Information: the name and/or reference number of the product requested, the quantity required and, where applicable, the colour, size, material, finish and any other identifying information we require; and
- Personal data: your title, first name, last name, telephone number, email address, delivery address and, where applicable, billing address.

We will inform you whether the requested Product is available and, if so, the purchase price of the product, the estimated collection or delivery date and any delivery charges. Please ensure that the delivery information you provide is correct. Incorrect information may result in a delay or loss of your order. LETRANGE PARIS will not be responsible for replacement or refund if the information you have provided is incorrect.

If you choose to continue with the order, you will receive an email or text message (depending on the chosen method of communication) containing a link to an external payment platform. Simply click on the link to be redirected to the payment platform where you will find the details of the order and the purchase price (" Order Information "). Before making the payment, you must verify the accuracy of the Order Information. The payment link will be valid 30 minutes after sending.

Regarding the accepted payment method, you can refer to article VI- Price, Accepted payment methods", it being specified that we are not able to accept PayPal and Shop PAY payments for telephone orders.

Once you have confirmed the order data and accepted these General Terms and Conditions of Sale and our Privacy Policy, you can proceed to payment of the order by clicking on the "Pay" button. LETRANGE PARIS will not have access to any banking data.

Once payment is made, you will receive an order summary. We recommend that you keep this email. LETRANGE PARIS will then process your order.

The contract of sale will be formed once you have placed your order. We will dispatch your Product subject to the availability of the purchased Product (as provided for in clause 4) and actual payment for the Product. You will receive a dispatch confirmation email when your order is dispatched.

The Order Data collected by LETRANGE PARIS constitutes proof of all transactions between LETRANGE PARIS and its customers. In the event of a dispute between LETRANGE PARIS and one of its customers relating to a transaction carried out on the Site, the Order Data collected by LETRANGE PARIS will be considered as irrefutable proof of the content of the transaction.

5.4. Invoices

Your invoice will be sent by LETRANGE PARIS in a shipping confirmation email. We do our best to ensure that our communications reach you in a timely manner. However, it is possible that some emails may be classified as spam. Therefore, we advise you to check your spam folder if you have not received your shipping confirmation email.

6. PRICES, ACCEPTED METHODS OF PAYMENT

6.1. Price

The prices of the Products are indicated in Euros, all taxes included. Except in cases of reimbursement made (i) in the context of exercising the right of withdrawal or for (ii) lack of conformity and hidden defects, LETRANGE PARIS will not reimburse the VAT applied to purchases made on the Site (even in the case where the buyer, after receipt, reships the Products to a third country).

The Products are invoiced on the basis of the prices displayed on the Site at the time you place your order, subject to availability.

All orders are payable in Euros and must be paid at the time of placing your order. In the event of unavailability of certain Products ordered (see Article IV “Availability of Products”), only the price and transport costs relating to the available Products will be debited.

6.2. Accepted payment methods

6.2.a) Payment by credit card or bank card

The credit cards and bank cards accepted are: Visa®, MasterCard®, American Express®, Carte Bleue®, Maestro®. Payments by bank card are authenticated and secured thanks to the 3D Secure system. This system is also known as "Verified by Visa®", "MasterCard® SecureCode" or "American Express SafeKey®". When paying, the bank asks the Internet user for personal information in order to verify the identity of the cardholder and validate the transaction.

How to pay with 3D Secure on letrange.paris?

After validating your bank details (card number, expiration date and cryptogram), a new page will appear on which you will have to enter the personal information requested by your bank. This information can be:
- the answer to a personal question;
- a password that you have chosen beforehand;
- a code sent by SMS,
- your date of birth...

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation email.
Authentication is specific to each bank. For any questions regarding your 3D Secure code, we invite you to contact your bank directly.
Your order can only be shipped after verification of your payment method and receipt of authorization to debit your card. Your account will be debited at the time your Order is shipped.

6.2.b) Payment by Paypal

We accept payments made by Paypal (except for telephone orders, Pre-orders and Customizations).

If you choose the Paypal payment option, you will be automatically redirected to the Paypal platform. If you do not have a PayPal account, you can create one at this time. After validating your order with Paypal, you will be redirected to the letrange.paris confirmation page.

6.2.c) Payment by Shop Pay

We accept payments made by ShopPay (except for phone orders, Pre-orders and Customizations).
If you choose the ShopPay payment option, you will be automatically redirected to the ShopPay platform. If you do not have a ShopPay account, you can create one at this time. After validating your order with ShopPay, you will be redirected to the letrange.paris confirmation page.

7. RETENTION OF TITLE

The Products ordered remain the property of LETRANGE 1838 PARIS until full payment of the price by LETRANGE 1838 PARIS.
On the other hand, you assume the risks (in particular of loss, theft or deterioration) linked to the Products delivered from their delivery to the address indicated when ordering or from their collection in the event of collection in store.


8. RIGHT OF WITHDRAWAL

8.1. Right and period of withdrawal

You have a legal right of withdrawal that you can exercise under the conditions provided for in Articles L221-18 and L221-20 of the Consumer Code, if you meet the conditions set out in these provisions, without having to provide reasons and without having to pay penalties.

The general return policy (for refund or exchange requests) of LETRANGE PARIS allows you to withdraw within fourteen (14) days from the date of delivery of the Products, without having to provide reasons and without having to pay a penalty. After this period, you will no longer be able to exercise your right of withdrawal.

8.2. Conditions for exercising the right of withdrawal

We offer you the possibility to complete and submit your withdrawal declaration by e-mail. You will then receive a confirmation of your withdrawal by e-mail without delay.
You can also send your withdrawal request by contacting our Customer Service or using the withdrawal form template available in the appendix to these General Conditions of Sale.

8.3. Consequence of the right of withdrawal

As part of the exercise of the right of withdrawal or in the event of non-conformity of the Product, you can return the Product(s) purchased by requesting an exchange or refund under the conditions described in the “refund policy” below.

 

9. LEGAL GUARANTEES

9.1. Legal guarantees

The Products sold by LETRANGE PARIS are subject to the legal warranty conditions provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other warranties:

- Legal guarantee of conformity (L217-4 to L217-14 of the Consumer Code):
LETRANGE PARIS will deliver to you a Product that complies with the contract and is free from defects of conformity upon delivery of said Product, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will have the characteristics described during the sale.

- Legal guarantee of hidden defects (art. 1641 to 1648 of the civil code):
LETRANGE PARIS will provide you with a Product free of hidden defects that would make it unfit for the use for which it is intended, or that reduce this use so much that you would not have purchased it, or would have paid a lower price for it, if you had known about them. This warranty will only apply on condition that you make the request within two (2) years from the discovery of the defect and in any case within five (5) years from the date of purchase.

In the event of a hidden defect, you will have the choice of returning the Product and having the price and costs incurred by the sale refunded or of keeping the Product and having part of the price refunded. In all cases, it will be up to you to prove that you meet the conditions of the guarantee.

In the event of a lack of conformity or hidden defects, you must return the Products to LÉTRANGE PARIS by contacting our Customer Service.

10. AFTER-SALES SERVICE AND AVAILABILITY OF SPARE PARTS

Any technically repairable Product benefits from an after-sales service. For any repair, please contact our Customer Service.
In accordance with Article L 111-3 al 1 of the Consumer Code, LETRANGE PARIS confirms that no period of availability of spare parts essential to the use of the Products is guaranteed. LETRANGE PARIS will nevertheless make its best efforts to satisfy its Customers in the event of a request for one or more spare parts.

11. LIMITATION OF LIABILITY

Under no circumstances may LETRANGE PARIS be held liable for any damage that does not result from a failure by LETRANGE PARIS to fulfill one of its obligations.

12. APPLICABLE LAW - DISPUTES

These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law. In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, you may contact our Customer Service. You may also use a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with Ordinance No. 2015-1033 of August 20, 2015 and Implementing Decree No. 2015-1382 of October 30, 2015, any dispute or litigation referred to as consumer disputes, subject to Article L612-2 of the Consumer Code, may be subject to amicable settlement by mediation with the CMAP – Mediation and Arbitration Center of Paris. To submit a dispute to the mediator, the customer can (i) fill out the form on the CMAP website: www.cmap.fr tab "you are: a consumer" (ii) send his request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr. Regardless of the means used to contact the CMAP, your request must contain the following elements to be processed quickly: your postal, email and telephone contact details as well as the full name and address of LÉTRANGE, a brief statement of the facts, and proof of the prior steps taken with LÉTRANGE.

In the event of a dispute relating to the execution of an order, if you are a natural person end consumer, you have the possibility of using a conventional mediation procedure or any other alternative dispute resolution procedure free of charge. You may, if you wish, use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No 524/2013. This platform is accessible at the following address: https://webgate.ec.europa.eu/odr/. Recourse to mediation is an alternative mechanism which is not a prerequisite for taking legal action.
